1. Acceptance of Terms
These Terms & Conditions ("Terms") govern your access to and use of The CBC's mobile application and related services (the "Service"), operated by [Company Legal Name] ("we", "us", "our"). By creating an account, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years old to use the Service, and you must provide accurate registration information, including a real date of birth. If you are using the Service on behalf of an organization (for example, administering a group), you confirm you have the authority to bind that organization to these Terms.
3. Account Registration & Security
- You're responsible for keeping your password and wallet withdrawal PIN confidential, and for all activity that occurs under your account.
- Notify us immediately if you suspect unauthorized access to your account.
- Usernames must be 3–20 characters (letters, numbers, underscores) and must not impersonate another person or brand.
- We may suspend or terminate accounts that provide false information or violate these Terms (see Section 10).
4. Description of Service
The Service includes, among other things: a social feed with posts, reels, and stories; groups with optional paid subscriptions; a direct-messaging inbox; events and a jobs board; an in-app wallet with M-Pesa deposits and withdrawals; paid post/group boosts; and periodic contests and promotions ("Be the STAR", "Tap & Win"). We may add, change, or remove features at any time.
5. Wallet & Payments
Your in-app wallet holds a balance in Kenyan Shillings (KES) that you can top up via M-Pesa and use across the Service (subscriptions, boosts, etc.), or withdraw back to M-Pesa. The following terms apply to withdrawals, and reflect our current configuration exactly:

- Withdrawals require your 4-digit wallet PIN and are subject to admin approval before the M-Pesa payout is sent.
- We are not responsible for delays or failures caused by Safaricom's M-Pesa network; a failed withdrawal is refunded to your wallet.
- We may change the minimum withdrawal amount, service fee, or tax rate at any time — the figures shown above always reflect the current configuration.
- Wallet balances are not bank deposits, are not interest-bearing, and are not insured or guaranteed by any government deposit insurance scheme.
6. Group Subscriptions
Each paid subscription payment is currently split as follows:

- Subscriptions grant access to a specific group's content/tier for the period stated at purchase and do not automatically renew unless the app indicates otherwise at checkout.
- Group admins are independent users, not our employees or agents — we do not control, and are not responsible for, the content or conduct of any individual group or its admin.
- Subscription payments are generally non-refundable except where required by law or expressly stated at the time of purchase.
7. Boosts & Sponsored Content
Post and group "boosts" let you pay to increase a post's or group's visibility to a targeted audience (by campus, gender, age range, or county) for a limited period shown at purchase. Boost fees are paid from your wallet and are non-refundable once the boost period has started, except where required by law.
8. Contests & Promotions
From time to time we run contests and promotions such as "Be the STAR" (video submission contests with cash prizes) and "Tap & Win" (an in-app prize game). For each contest or promotion:
- Specific eligibility rules, submission windows, and prize amounts are shown in-app and form part of these Terms for that contest.
- Prizes are credited to your in-app wallet and are subject to the withdrawal terms in Section 5.
- We may modify, suspend, or cancel a contest or promotion at any time, including for suspected fraud, abuse, or technical error, and our decisions on submissions, scoring, and winners are final.
- You retain ownership of content you submit to a contest, but grant us the license described in Section 11 to use it as part of operating and promoting the contest.
9. User Content & Conduct
You agree not to post or send content that:
- Is unlawful, defamatory, harassing, hateful, or sexually exploitative (particularly involving minors)
- Infringes someone else's intellectual property or privacy rights
- Impersonates another person or organization, or is fraudulent (including payment/withdrawal fraud)
- Spreads spam, malware, or deliberately false information
- Attempts to manipulate contests, boosts, group subscriptions, or the wallet system (e.g. fake accounts, collusion, or exploiting bugs)
10. Moderation & Enforcement
We may review, warn about, remove, or restrict content and accounts that violate these Terms, whether flagged by another user's report or found through our own review. Depending on severity, we may issue a warning, temporarily suspend, or permanently ban an account. We aim to be fair and consistent, but enforcement decisions are made at our reasonable discretion.
11. Intellectual Property
You retain ownership of the content you create and post. By posting content on the Service, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute it solely for the purpose of operating, promoting, and improving the Service (for example, showing your post in other users' feeds, or a "Be the STAR" winning video in promotional material with credit to your TikTok handle if provided). This license ends when you delete the content or your account, except for copies already shared by other users prior to deletion. The CBC's own branding, logos, and app design remain our property.
12. Third-Party Services
The Service relies on third-party providers, including Safaricom (M-Pesa payment processing) and push notification and email infrastructure providers. Your use of M-Pesa is also subject to Safaricom's own terms. We are not responsible for the acts or omissions of these third parties, though we take reasonable steps to work with reputable providers.
13. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
14. Limitation of Liability
To the fullest extent permitted by law, The CBC and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of the Service. Our total liability for any claim arising from these Terms or the Service is limited to the greater of KES 5,000 or the amount you paid us in the 3 months before the claim arose. Nothing in these Terms limits liability that cannot lawfully be limited (for example, liability for fraud or death or personal injury caused by negligence).
15. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms, your content, or your misuse of the Service.
16. Termination
You may stop using the Service and delete your account at any time from Account Settings. We may suspend or terminate your access if you violate these Terms, at our reasonable discretion, and to the extent permitted by law. On termination, your wallet balance (if any) will be handled in accordance with Section 5 and applicable law — contact us using the details in Section 19 if you need to withdraw a remaining balance.
17. Governing Law & Dispute Resolution
These Terms are governed by the laws of Kenya, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Kenya, unless applicable consumer-protection law in your country of residence provides otherwise.
18. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above and, where appropriate, notify you in-app. Continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.
