1. Acceptance of Terms

These Terms & Conditions ("Terms") govern your access to and use of The CBC's mobile application and related services (the "Service"), operated by [Company Legal Name] ("we", "us", "our"). By creating an account, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service, and you must provide accurate registration information, including a real date of birth. If you are using the Service on behalf of an organization (for example, administering a group), you confirm you have the authority to bind that organization to these Terms.

The Service includes, among other things: a social feed with posts, reels, and stories; groups with optional paid subscriptions; a direct-messaging inbox; events and a jobs board; an in-app wallet with M-Pesa deposits and withdrawals; paid post/group boosts; and periodic contests and promotions ("Be the STAR", "Tap & Win"). We may add, change, or remove features at any time.

5. Wallet & Payments

Your in-app wallet holds a balance in Kenyan Shillings (KES) that you can top up via M-Pesa and use across the Service (subscriptions, boosts, etc.), or withdraw back to M-Pesa. The following terms apply to withdrawals, and reflect our current configuration exactly:

7. Boosts & Sponsored Content

Post and group "boosts" let you pay to increase a post's or group's visibility to a targeted audience (by campus, gender, age range, or county) for a limited period shown at purchase. Boost fees are paid from your wallet and are non-refundable once the boost period has started, except where required by law.

From time to time we run contests and promotions such as "Be the STAR" (video submission contests with cash prizes) and "Tap & Win" (an in-app prize game). For each contest or promotion:

10. Moderation & Enforcement

We may review, warn about, remove, or restrict content and accounts that violate these Terms, whether flagged by another user's report or found through our own review. Depending on severity, we may issue a warning, temporarily suspend, or permanently ban an account. We aim to be fair and consistent, but enforcement decisions are made at our reasonable discretion.

11. Intellectual Property

You retain ownership of the content you create and post. By posting content on the Service, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute it solely for the purpose of operating, promoting, and improving the Service (for example, showing your post in other users' feeds, or a "Be the STAR" winning video in promotional material with credit to your TikTok handle if provided). This license ends when you delete the content or your account, except for copies already shared by other users prior to deletion. The CBC's own branding, logos, and app design remain our property.

12. Third-Party Services

The Service relies on third-party providers, including Safaricom (M-Pesa payment processing) and push notification and email infrastructure providers. Your use of M-Pesa is also subject to Safaricom's own terms. We are not responsible for the acts or omissions of these third parties, though we take reasonable steps to work with reputable providers.

13. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

14. Limitation of Liability

To the fullest extent permitted by law, The CBC and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of the Service. Our total liability for any claim arising from these Terms or the Service is limited to the greater of KES 5,000 or the amount you paid us in the 3 months before the claim arose. Nothing in these Terms limits liability that cannot lawfully be limited (for example, liability for fraud or death or personal injury caused by negligence).

15. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms, your content, or your misuse of the Service.

16. Termination

You may stop using the Service and delete your account at any time from Account Settings. We may suspend or terminate your access if you violate these Terms, at our reasonable discretion, and to the extent permitted by law. On termination, your wallet balance (if any) will be handled in accordance with Section 5 and applicable law — contact us using the details in Section 19 if you need to withdraw a remaining balance.

17. Governing Law & Dispute Resolution

These Terms are governed by the laws of Kenya, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Kenya, unless applicable consumer-protection law in your country of residence provides otherwise.

18. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above and, where appropriate, notify you in-app. Continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.
